FCC Awards Bids for Audits of Universal Service Funding

On July 31, 2006 USAC awarded bids for audits of the Universal Service Fund to several CPA firms. This award covers approximately 60 audits of Federal High Cost Funding. This is significantly fewer audits than the FCC planned to perform when it initially announced its plans in early 2005. It is our understanding that both ILEC Eligible Telecommunications Carriers ("ETCs") and Competitive ETCs will be eligible for audit. These audits are expected to kick off this fall and will be completed over the next 12 months.

For rural ILECs, Federal High Cost Funding includes the following support mechanisms: High Cost Loop Support, Local Switching Support, Interstate Common Line Support, Safety Net Additive Support, and Safety Valve Support. In addition, Federal High Cost Funding includes High Cost Model Support and Interstate Access Support for non-rural carriers.

Missoula Plan for Intercarrier Compensation Reform Released

On July 25, 2006 the FCC released a Public Notice seeking comment on the Missoula Plan for intercarrier compensation reform filed by the National Association of Regulatory Utility Commissioners ("NARUC") Task Force on Intercarrier Compensation ("NTFIC"). Comments on the Missoula Plan are due to the FCC by September 25, 2006 and Reply Comments are due by November 9, 2006. Click here to review Moss Adams' summary of the Missoula Plan.

Federal Excise Tax Reminder

Pursuant to IRS Notice 2006-50, effective August 1, 2006, the federal excise tax only applies to local-only service and no longer applies to nontaxable service. Nontaxable service is defined as bundled service and long distance service. Collectors (telephone companies) or taxpayers may request a refund of excise tax payments for nontaxable service from February 28, 2003 through July 31, 2006.
