PAID FAMILY LEAVE – WHAT YOU SHOULD KNOW

California's Paid Family Leave (PFL) took effect January 1, 2004. PFL covers all California employers; however, many remain unaware or uncertain of its requirements.
PFL provides partial wage replacement to employees who miss work to care for a seriously ill child, spouse, parent or domestic partner, or to bond with their newborn or newly adopted child, or child newly placed in foster care. The
Program is employee-paid through increased paycheck withholdings for State Disability Insurance (SDI).
Employees cannot file PFL claims until July 1, 2004. PFL pays up to 55 percent of lost wages (capped at $728/week) for up to six weeks during a one-year period. Employees must file a claim with the Employment Development Department
(EDD), which administers PFL, no later than 41 days after the first day the employee is eligible for a compensable benefit. Benefits are paid out of the State Disability Fund.
There is a seven (7) day, unpaid waiting period before PFL benefits kick in. Employers may require employees who accrue vacation to use up to two weeks (10 days) of their accrued vacation before receiving benefits. Employees are not
eligible for PFL if already receiving SDI, Unemployment Insurance or Workers' Compensation benefits. Pregnancy disability leaves and family care leave for bonding with a newborn child are considered one disability benefit period.
PFL must be taken concurrently with other leaves under existing laws. PFL was not intended to bestow additional leaves upon employees already entitled to other protected leaves; it simply provides partial pay during that leave. If an
employee is not eligible for a protected leave under state or federal law, then the employee remains entitled to PFL benefits; however, there is no right to reinstatement following an absence for PFL. Additionally, an employer can have a
policy that vacation, sick leave or PTO benefits will not accrue during a PFL absence.
Since January 1, 2004, employers have been required to give all new hires written notice of PFL rights and benefits. Any employee who takes a PFL leave on or after July 1, 2004 must be given another notice of their PFL rights and
benefits. Employers must also have PFL claim forms available for employee use.

remove chicken from the Asian Chicken, Chicken Caesar, Spinach, Greek, House and Antipasto salads ($3.49-$6.99).
With great prices like these, you will want to save room for an order of Wilde Bread, bakery fresh dough, seasoned with garlic and herbs and served with ranch or classic red sauce ($3.49); or Frosted CinnaBread, warm desert pie smothered
with brown sugar, cinnamon and icing ($2.99).
