Voter's Guide

Every election cycle, the Board of Directors of the San Diego Regional Chamber of Commerce takes a position on ballot measures that impact the business climate of the region and state. For the November 8, 2005 statewide special election, the Chamber's Board of Directors has taken the following positions:

CITY OF SAN DIEGO

Proposition 74…YES
Public School Teachers – Waiting Period For Permanent Status

Summary:
-Extends the probationary period for the tenure of new certificated teachers to five years (currently 2 years)
-States that two consecutive unsatisfactory performance evaluations constitute unsatisfactory performance for the purpose of dismissing permanent employees

Rationale: The Chamber Board voted to support this measure because it will require teachers to perform well for five years instead of just two before they become eligible for permanent "guaranteed" employment. With a five-year waiting period, teachers will have a greater opportunity to demonstrate expertise and that they deserve tenure – principals have more time to evaluate teachers.

Public Employee Union Dues, Restrictions on Political Contributions

Summary:
-Requires public employee unions to get annual, written consent from a government employee in order to charge and use that employee's dues or fees for political purposes
-Requires unions to keep certain records, including copies of any consent forms

Rationale: The Chamber Board voted to support this measure because it is only fair that public employees give their permission before a portion of their wages are taken from their paychecks and given to politicians and political campaigns. This measure does not prohibit the use of union member dues for a union's political purposes – it only requires an annual consent by the member.

State Spending and School Funding Limits

Summary:
-Places limits on the annual growth in state expenditures
-If a budget is not enacted prior to the beginning of a new fiscal year, requires that the spending levels authorized in the prior-year's budget act remain in effect until a new budget is enacted; therefore, funding would continue for all state programs that have received budget act appropriations in the prior year
-Extends the Governor's authority to declare a state of fiscal emergency
- Once the Governor declares the emergency, the Legislature would be called into special session and has 45 days to enact legislation addressing the shortfall. If such legislation is not enacted, the measure grants the Governor new powers to reduce state spending to eliminate the shortfall.

Rationale: The Chamber Board voted to support this measure because it forces the state government to live within its means. Limits spending to the average rate of tax growth of the past three years, so we don't overspend in good times followed by huge deficits in bad times. The measure establishes "checks and balances" to encourage the Governor and Legislature to work together.
